These Terms of Service govern your access to and use of the PatchMyWeb website, reports, and services.

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of the PatchMyWeb website, reports, and services (“Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

2. Services

PatchMyWeb provides services including website accessibility audits, security assessments, performance analysis, SEO analysis, technical website reviews, website remediation services, verification audits, and related consulting services.

Services may change, be expanded, modified, or discontinued at any time.

3. Customer responsibilities

You represent that you own the website being submitted for service or have authorization from the owner to request our services.

If remediation work or security testing is requested, you are responsible for ensuring you have all necessary permissions.

4. Audit results

Website audits are based on automated scanners, publicly available website information, and professional analysis. Although we strive for accuracy, reports may contain false positives, some issues may remain undetected, websites may change after an audit, and scanner limitations exist.

Audit reports are informational and should not be interpreted as guarantees that a website is secure, compliant, error-free, or optimized.

5. Remediation services

Where remediation services are purchased, recommendations are implemented using commercially reasonable efforts. Improvements depend on the website platform and third-party software.

Some findings cannot reasonably be corrected because of hosting providers, themes, plugins, CMS limitations, browser behavior, or third-party services. Unless specifically agreed in writing, PatchMyWeb does not guarantee that every reported issue can be resolved.

6. Accessibility

Accessibility standards evolve over time. Although our services aim to improve website accessibility, we do not guarantee compliance with any law, regulation, accessibility standard, or certification, including WCAG, ADA, or similar legal requirements.

Customers remain responsible for their own legal compliance.

7. Security

Security assessments reduce risk but cannot eliminate it. PatchMyWeb does not warrant that a website is free from vulnerabilities, future vulnerabilities will not arise, or security incidents cannot occur.

Unless explicitly agreed in writing, services are limited to passive or owner-authorized baseline assessments and do not include intrusive penetration testing.

8. Third-party tools

Our services rely on industry-standard third-party software, scanners, frameworks, browsers, APIs, and open-source components. PatchMyWeb is not responsible for inaccuracies originating from third-party tools, temporary service outages, scanner limitations, or changes made by third-party vendors.

9. Payment

Fees are due according to the agreed quotation or invoice. Payments are processed through Stripe or another designated payment processor. Failure to pay may result in suspension or cancellation of services.

10. Refunds

Unless otherwise agreed in writing, completed audits, completed remediation work, consulting services, and custom work are non-refundable. Refund requests for exceptional circumstances may be considered at our sole discretion.

11. Intellectual property

All reports, software, documentation, website content, branding, and other materials created by PatchMyWeb remain our intellectual property unless otherwise agreed in writing.

Customers receive a license to use reports for their internal business purposes. These Terms do not transfer ownership of PatchMyWeb software or proprietary technology.

12. Limitation of liability

To the fullest extent permitted by law, PatchMyWeb shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, business interruption, lost revenue, lost data, reputational harm, or cybersecurity incidents.

Our total liability arising out of any claim relating to the Services shall not exceed the amount paid by the customer for the specific Services giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless PatchMyWeb from claims, damages, liabilities, losses, and expenses arising from your misuse of the Services, unauthorized requests, violations of applicable law, or violations of these Terms.

14. Termination

We may suspend or terminate services at any time if these Terms are violated, fraudulent activity is suspected, payment is not received, or continuing service would create legal or security risks.

15. Governing law

These Terms shall be governed by the applicable laws of the governing jurisdiction, without regard to its conflict of law rules.

16. Changes to these Terms

We may modify these Terms from time to time. The updated version becomes effective upon publication on our website. Continued use of the Services constitutes acceptance of the revised Terms.
